Article 1 – Definitions
In these terms and conditions the following terms shall have the following meanings:
Supplementary agreement:
An agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract and these goods, digital content and/or services are supplied by the entrepreneur or a third party on the basis of an agreement between that third party and the entrepreneur.
Reflection period:
The period within which the consumer can exercise his right of withdrawal.
Consumer:
The natural person who is not acting for purposes relating to his trade, business, craft or profession.
Day:
Calendar day.
Digital content:
Data produced and supplied in digital form.
Duration contract:
An agreement that provides for the regular supply of goods, services and/or digital content over a given period.
Durable medium:
Any instrument – including e-mail – that enables the consumer or the entrepreneur to store information addressed personally to him in a way accessible for future consultation or use for a period of time adequate to the purpose for which the information is intended and which allows for the unchanged reproduction of the stored information.
Right of withdrawal:
The option for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur:
The natural or legal person who is a member of the Dutch Thuiswinkel Organisation and who offers products, (access to) digital content and/or services remotely to consumers.
Distance contract:
An agreement concluded between the entrepreneur and the consumer within the framework of an organised system for the distance sale of products, digital content and/or services, whereby exclusive or partly use is made of one or more means of distance communication up to and including the conclusion of the agreement.
Model withdrawal form:
The European model withdrawal form included in Appendix I of these terms and conditions. Appendix I does not need to be made available if the consumer does not have a right of withdrawal in respect of his order.
Distance communication technique:
A means that can be used to conclude an agreement, without the consumer and entrepreneur having to be together in the same place at the same time.

Article 3 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate how the terms can be consulted and that they will be sent free of charge at the consumer’s request.
If the distance contract is concluded electronically, the text of these general terms and conditions may be made available electronically in such a way that the consumer can store it on a durable data carrier.
If specific product or service conditions apply in addition to these general terms and conditions, the consumer may rely on the provision most favourable to him.
Article 4 – The Offer
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the products, digital content, and/or services offered.
If the entrepreneur uses images, these are a true representation of the products, services, and/or digital content offered.
Obvious mistakes or errors in the offer are not binding on the entrepreneur.
Each offer contains information that makes clear to the consumer what rights and obligations apply upon acceptance.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set therein.
If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt electronically.
If the agreement is concluded electronically, appropriate technical and organisational security measures will be taken.
The entrepreneur may assess whether the consumer can meet payment obligations and may refuse an order or impose conditions.
At the latest upon delivery, the entrepreneur will provide the consumer with:
● The visiting address for complaints
● Conditions and procedures for exercising the right of withdrawal
● Information about guarantees and after-sales service
● The total price including taxes and delivery costs
● Payment, delivery, or performance methods
● Termination requirements
● The model withdrawal form (if applicable)
Article 6 – Right of Withdrawal
For products
The consumer can dissolve an agreement during a reflection period of 30 days without giving reasons.
The reflection period commences on the day after the consumer or a designated third party receives the product.
This applies to:
● Multiple products in one order
● Products delivered in parts or shipments
● Regular delivery agreements
For services and digital content not supplied on a tangible medium
The consumer can cancel within 30 days without giving reasons.
The cooling-off period starts on the day following the conclusion of the agreement.
Extended reflection period
If legally required withdrawal information was not provided, the reflection period expires twelve months after the original period.
If provided within twelve months, the period expires 30 days after receipt of the information.
Article 7 – Consumer Obligations During the Reflection Period
The consumer shall handle the product and packaging with care.
The consumer is liable only for diminished value resulting from handling beyond what is permitted.
No liability applies if withdrawal information was not provided.
Article 8 – Exercise of the Right of Withdrawal
The consumer must notify the entrepreneur within the cooling-off period.
Products must be returned within 14 days.
Products must be returned with all accessories and in original condition where possible.
Return costs are borne by the consumer unless stated otherwise.
Additional rules apply to services, utilities, and digital content as stated.
All supplementary agreements are terminated automatically upon withdrawal.
Article 9 – Obligations of the Entrepreneur in Case of Withdrawal
Electronic withdrawal notifications will be acknowledged immediately.
Reimbursement will be made within 14 days.
The original payment method will be used unless agreed otherwise.
Article 10 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for products and services including:
● Market-dependent products
● Public auction purchases
● Fully performed services
● Accommodation, transport, and catering services
● Custom-made products
● Perishable goods
● Hygiene-sealed products once opened
● Digital content supplied after consent
Article 11 – The Price
Prices remain unchanged during the offer period, except for VAT changes.
Variable prices subject to market fluctuations may apply.
Prices include VAT.
Article 12 – Compliance with the Agreement and Additional Warranty
Products and services must comply with the agreement and legal standards.
Additional warranties do not limit statutory consumer rights.
Article 13 – Delivery and Execution
Orders will be executed within 30 days unless agreed otherwise.
Delayed orders entitle the consumer to cancellation and refund.
Risk remains with the entrepreneur until delivery.
Article 14 – Duration Transactions
Termination
The consumer may terminate agreements with a notice period of no more than one month.
Extension
Fixed-term agreements may not be automatically renewed, except where stated.
Duration
Agreements longer than one year may be terminated after one year.
Article 15 – Payment
Payments must be made within 14 days.
Advance payments may not exceed 50%.
Late payments may result in statutory interest and collection costs.
Article 16 – Complaints Procedure
Complaints must be submitted clearly and within a reasonable time.
Responses will be provided within 14 days.
The entrepreneur must be given 4 weeks to resolve the complaint.
Article 17 – Disputes
All agreements are governed exclusively by Dutch law.
